Terms & Conditions

TERMS & CONDITIONS

We’ve tried to make these terms and conditions as short as possible, but it is important that we are all on the same page! Please read these terms and conditions carefully. These terms and conditions were updated on 10th Jan 2022 and will be reviewed on a regular basis.

These terms and conditions apply to lessons provided by Hogan Music outside of school settings. Separate terms and conditions are available for Hogan Music in Schools lessons.

1. Hogan Music Lesson Membership (weekly ongoing lessons)
1.1. Membership is based upon a monthly, rolling contract for lessons with an average of 4 lesson per month (48 lessons per year).
1.2. Lessons are paid for on a monthly basis in advance.
1.3. The first month of lessons is paid for at time of booking.
1.4. Subsequent lessons are paid for by direct debit on a monthly basis.
1.5. There is a 14-day cooling off period from the date of submitting this agreement.

2. Cancelling Your Membership
2.1. Hogan Music Lesson Membership may be cancelled at any time by providing 1-month notice to Hogan Music using the contact details below.
2.2. Cancelling/non-payment of the direct debit mandate constitutes cancelling your Hogan Music Lessons Membership. Cancelling/non-payment of direct debit is not in lieu of the 1-month notice period.
2.3. If there are unused lessons on your account after cancelling, we will attempt to contact you three times within a 6-month period to arrange fulfilling the lessons.

3. Hogan Music Lessons Pay as You Learn (one-off lessons)
3.1. Pay as You Learn lessons are paid for in advance at the time of booking.
3.2. Lessons are confirmed upon receipt of payment.
3.3. Lesson times cannot be reserved without payment.
3.4. Multiple lessons can be booked at one time if payment is made in full at the time of booking.

4. Lesson Fees
4.1. Lesson fees may be revised from time to time.
4.2. Changes to lesson fees will not affect lessons already paid for or to those that direct debit payments have already been allocated to.
4.3. Hogan Music Lesson Members will be provided with at least 1-months’ notice of any changes to fees.

5. Membership Discounts
5.1. The following discounts are available on memberships:
5.1.1. Pupil Premium Discount (10% reduction);
5.1.2. Family Discount (10% reduction) – a sibling or other immediate family member from the same household is also learning with Hogan Music. This discount is applied to the second and subsequent family member(s).
5.1.3. Second instrument Discount (10% reduction) – the same student is learning more than one instrument. Discount is applied to second and subsequent instruments being learned (including voice).
5.2. A maximum of one discount is available to any one student.
5.3. We will contact the school requesting evidence for those requesting the Pupil Premium Discount.

6. Sickness and Cancelling a Lesson
6.1. Lessons can only be cancelled by:
6.1.1. contacting Hogan Music directly using the details below;
6.1.2. using the ‘cancel booking’ link in confirmation emails; or,
6.1.3. via the Hogan Music portal.
6.2. Lesson cancellations require at least 24hours notice.
6.3. Lessons that have been cancelled with 24hours notice or more can be rescheduled.
6.4. Lessons that have been cancelled with less than 24hours notice will be forfeited. We will be unable to rearrange these lessons.

7. Non-attendance and Late Arrival
7.1. If a student fails to attend a lesson without notice (‘non-attended lesson’), the lesson will be forfeited and is deemed as cancelling a lesson with less than 24hours notice
7.2. Four consecutive non-attended lessons will be regarded as having handed in notice with the first missed lesson being the first week of the four-week notice.
7.3. If a student is late to a lesson, the teacher will endeavour to extend the lesson by the same amount of time subject to the teacher’s availability. However, this cannot be guaranteed.
7.4. If a teacher is late to a lesson, the teacher will extend the lesson by the same amount of time or offer to make the missed lesson time up at an agreeable time. If an agreeable time is unable to be found, any lesson payment will be reallocated to an unpaid lesson.

8. Lessons Alternatives
8.1. In exceptional circumstances when face-to-face lessons are not available (for example social restrictions, travel restrictions, adverse weather, force majeure etc.), Hogan Music may switch to online delivered lessons for all students to provide consistency of learning.
8.2. Temporary or permanent switching to online lessons for other reasons can be requested by the student/parent/carer, teacher or Hogan Music. If the student is under 18, agreement will be sought from the account holder.
8.3. For Hogan Music at Home students, temporary or permanent switching to face-to-face lessons can be requested.
8.4. In cases where a teacher is absent due to illness, holiday or other appropriate reason, an alternative teacher will be provided where possible.

9. Requesting to Change Teacher and/or Lesson Location
9.1. A student or account holder may wish to request a change of teacher or a change of location, e.g. from Hogan Music in Newbury to a school based lesson.
9.2. A change of teacher can be requested at any time by providing a 1-month notice period to Hogan Music using the contact details below.
9.3. If a change of location is requested and the teacher remains the same, no notice period is required, and the request will be actioned as soon as possible.
9.4. If a change of location also means a change of teacher, a 1-month notice period will be required to be provided to Hogan Music using the details below.
9.5. Any requested teacher or location changes are subject to availability of the teacher or the new location.

10. Data Protection
10.1. All member information is kept in accordance with the Data Protection Act 1998.
10.2. By signing this agreement, you are agreeing to Hogan Music storing and processing your data in line with the Data Protection Act 1998.
10.3. We hold student records for a period of 6months from the date of their last lessons. After this, student’s records are permanently removed.
10.4. Hogan Music does not store any bank or card details

11. Complaints
11.1. Hogan Music prides itself on delivering the best possible lessons and experience for its’ students and welcomes constructive feedback as part of our own ongoing learning process.
11.2. If you feel that we have not met our own high standards or are dissatisfied with any aspect of the service you have received, we encourage you to tell us or to make a complaint.
11.3. All complaints and feedback will be treated seriously, fairly and, if appropriate, in confidence.
11.4. If appropriate, the person making the complaint will be kept informed of progress made regarding the complaint through to resolution.
11.5. A separate policy applies for safeguarding and child protection related issues.
11.6. In the first instance, all complaints should be made to the Hogan Music using the details below. Concerns relating to safeguarding and child protection should be referred to Hogan Music’s Designated Safeguarding Lead using the details below.
